1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of prblyfine.com and the services provided by Probably Fine LLC ("PRBLY," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.
These Terms constitute a legally binding agreement between you and PRBLY. We may revise these Terms at any time; continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age and legally able to consent to medical treatment in your state of residence to use our telehealth Services. By using the Services, you represent and warrant that you meet these requirements.
Telehealth services and prescription availability vary by state. PRBLY and its provider network operate only in jurisdictions where they are licensed. We do not guarantee that a provider will be available or that any particular medication will be prescribed in your state.
3. No Provider-Patient Relationship Until Consultation
Browsing this website, reading our content, or completing an intake does not establish a provider-patient relationship. A provider-patient relationship is formed only once a licensed healthcare provider has reviewed your intake, accepted you as a patient, and a consultation has occurred.
The information on this website is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this site.
4. Telehealth Informed Consent
By using our Services, you acknowledge and consent to receive healthcare services via telehealth, which involves the use of electronic communications to connect you with licensed providers. You understand and agree that:
- Telehealth consultations may involve video, telephone, or asynchronous (text-based) communication
- Telehealth may not be appropriate for all medical conditions and a provider may determine that an in-person evaluation is necessary
- There are potential risks, including technology failures, interruptions, and limitations in the ability to perform physical examinations
- Your provider will determine whether telehealth is appropriate for your specific situation
- You may withdraw consent for telehealth services at any time without affecting your right to future care
5. Prescriptions & Compounded Medications
All medications, including compounded medications and peptides, are available only with a valid prescription from a licensed healthcare provider following a medical evaluation. A prescription is never guaranteed; prescribing decisions are made by the provider based on their independent clinical judgment.
Compounded Medications
Compounded medications are prepared by licensed compounding pharmacies pursuant to a prescription. You acknowledge that:
- Compounded drugs are not FDA-approved. The FDA does not verify the safety, effectiveness, or quality of compounded medications
- Compounded medications are prepared in compliance with applicable state pharmacy laws and USP standards
- Compounded medications are an alternative when an FDA-approved drug is unavailable or a specific formulation is medically necessary
Peptides & Regenerative Therapies
Certain peptides and regenerative therapies discussed on this site may be prescribed off-label. Off-label use is legal and common but means the FDA has not approved the medication for that specific use. Your provider will discuss the risks, benefits, and alternatives before prescribing.
6. Not for Emergencies
PRBLY's Services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not rely on our Services for urgent or emergency care. Our providers may not be available outside of scheduled consultation hours.
7. Accounts, Orders & Payment
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information during intake and checkout.
Subscription and refill programs may automatically renew unless canceled. You may manage or cancel subscriptions through your account or by contacting care@prblyfine.com. Refunds are subject to our Return & Refund Policy and applicable law; certain prescription products may not be returnable.
8. User Conduct
You agree not to:
- Provide false, misleading, or incomplete medical information
- Use the Services to obtain medications for anyone other than yourself
- Misuse, resell, or distribute prescribed medications
- Attempt to access data or systems you are not authorized to access
- Interfere with the proper functioning of the site or services
9. Intellectual Property
All content on this site—including text, graphics, logos, images, articles, and software—is the property of PRBLY or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, PRBLY disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any treatment will be effective for you.
11. Limitation of Liability
To the fullest extent permitted by law, neither PRBLY nor its officers, employees, providers, affiliates, or partners shall be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. This includes, without limitation, damages for loss of profits, data, or health outcomes. Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless PRBLY and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class action.
